Privacy Policy


1. Introduction

The application med-E-request, and the Developer respects the privacy of every person using the med-E-request application (‘the App’). We will comply with all applicable data protection laws and regulations. This privacy policy sets out the Developer’s approach towards the use of personal information.


2. Who is med-E-request?

med-E-request is a South African business focused on application development in South Africa. We can be contacted on mederequest@gmail.com.

The App can only be used by health care professionals. Medical practices, on behalf of the health care professionals who wish to use the App (the users), will register with Google’s Firebase. The practice will then provide each health care professional with a username and password to access the App. Users are referred to Google Firebase's privacy policy: https://firebase.google.com/support/privacy.


3. What does med-E-request do?

med-E-request creates automated booking forms via PDF that can be sent using Mac Mail. The App is designed for the exclusive use of healthcare professionals within South Africa.

We therefore facilitate a secure and efficient booking and investigation request system that creates PDF request forms using data from health care professionals. We do not collect, store or process any of this information, and we cannot access it.


4. What data does med-E-request collect?

med-E-request is designed to collect no personal information. Users will require a username and password to access and use the App, but we do not store, collect or process any personal information – Google’s Firebase will store the usernames and passwords of authorized healthcare professionals, and medical practices will sign up with the Google’s Firebase on behalf of authorized users.

The App complies with all applicable data protection legislation, including the Protection of Personal Information Act 4 of 2013 (‘POPIA’).


5. Sharing information with others: third party access

med-E-request will under no circumstances ever sell your personal information, and med-E-request will not share your information with any third party, other than those described in this section. In order to facilitate the automated booking requests provided by the App, med-E-request is powered by Google’s Firebase Backend-as-a-Service and Apple’s Mac Mail – the privacy policy for Firebase is https://firebase.google.com/support/privacy.


6. Personal information about children and special personal information

med-E-request does not collect personal information about children.

med-E-request does not collect or store any “special personal information” as defined in POPIA, which includes for example political, religious or health-related information.


7. Data retention/deletion policies

As set out above, we do not collect, process or store any personal data. In the event a user would like to request deletion of their username, that request should be sent to the user’s medical practice, with a copy sent to mederequest@gmail.com and we will follow up with the medical practice and ensure the username is removed from the Firebase database.

8. Changes to this policy

We may amend this policy from time-to-time, and will advise users of any changes via the App.


Terms and Conditions


1. Introduction

1.1. med-E-request (“the App”) is owned and operated by the Developer (“med-E-request”, “We”, “Our”), a business focused on application development. The use of the App is subject to the following terms and conditions (“Terms”).

1.2. The terms “User”, “You” and “Your” used in these Terms refers to any person who downloads, accesses or uses the App.

1.3. The App creates automated booking forms via PDF that can be sent using Mail. The App is designed for the exclusive use of healthcare professionals within South Africa. The App does not provide any medical advice, nor does it collect any personal information; it is designed solely to assist with administration.

1.4. Please read these Terms carefully. Your use of the App signifies your agreement to these Terms – these Terms constitute a fully binding agreement. If you do not agree to these Terms, you are prohibited from using the App.


2. Registration / Use of the App

2.1. By downloading, accessing and/or using the App you warrant that you are a medical professional in good standing with the Health Professions Council of South Africa, and further warrant that you have full legal capacity.

2.2. The App can be downloaded from the Apple Store on a mobile phone with iOS 13 or higher. To access the App, you must have a mobile device with paid access to a mobile data service provider. The App is free to download, however your provider’s rate and fees apply for downloading the App and for accessing and downloading data within the App.

2.3. med-E-request reserves the right, in its sole discretion, to deny membership, as well as any med-E-request offering, to anyone, for any reason whatsoever, as permitted by applicable law.

2.4. You acknowledge that you are responsible for maintaining the confidentiality of your member account, username and password and for restricting access to your mobile phone and/or computer. You agree and warrant that you will not disclose your username and password to any third party.

2.5. You agree to notify med-E-request immediately upon becoming aware of, or reasonably suspecting that your med-E-request account is no longer secure (for example, in the event of loss, theft or any unauthorised access to or use of your username and password) and to take steps to mitigate any resultant loss or harm.

2.6. We reserve the right to change, suspend, or terminate any account, including any feature, content, or service at any time for any reason.

2.7. We may place limitations on the use of certain services, content or features, and/or limit your access to parts if the App or services without notice or liability.


3. Fees & Billing

3.1. med-E-request is currently free to download from Apple’s App Store, but is subject to the medical practice providing the service to the user paying a license fee to Med-e-Request.

3.2. On reasonable notice to users, med-E-request reserves the right to change the billing structure.


4. Push and Email Notifications

4.1. As part of the installation of the App on your mobile device, you may be asked if you would like the App to send you “Push Notifications”, which may include alerts, badges, banners and sounds, on your mobile device. If you choose to allow Push Notifications then the App will generate Push Notification on your mobile device and you acknowledge and consent to receipt of these Push Notifications.

4.2. You agree to us sending you communications via email (“Email Notifications”).

4.3. You may opt out of receiving Email Notifications at any time by contacting the medical practice providing the service.


5. Disclaimers and Important Information

5.1. med-E-request disclaims all implied warranties, including but not limited to, warranties of compatibility, completeness, accessibility, safety, reliability, security, accuracy or any other aspect.

5.2. Although med-E-request has taken all reasonable steps to guard against viruses or destructive codes, it gives no warranty that the App is free of viruses or any other data or code that has the ability to corrupt or affect your system.

5.3. The use of the App in any form is entirely at the users’ own risk and the App is provided ‘as is’, and ‘as available’.

5.4. med-E-request is not liable for any damages whatsoever relating to your use of and/or access of the App in any manner, howsoever arising, including instances of loss caused by the negligence of med-E-request and/or its affiliates, partners or representatives.

5.5. Unless otherwise noted, the contents of this App are subject to intellectual property rights that vest in med-E-request, or that vest in other entities. You are thus prohibited from using the content in this App, its related web pages, social media channels, electronic or written publications or any other media and/or words, phrases, names, designs or logos without express written permission or unless used in accordance with these Terms.

5.6. All information, products and prices available on the App are subject to change without notice.


6. Limitation of Liability and Indemnity

6.1. In addition to clause 6 above, under no circumstances, including, but not limited to, negligence, will med-E-request, its affiliates, employees, agents or representatives be liable for any damages (of any kind) that result from the use of, or the inability to use, the materials or any information or service in or on the App.

6.2. In no event will med-E-request, its affiliates, employees, agents or representatives’ total liability to you for all damages, losses, and causes of action (whether in contract, delict or any other form of law otherwise) exceed two thousand South African Rand.

6.3. You agree to indemnify, defend and hold med-E-request, its affiliates and/or any of its directors, employees, agents and contractors harmless from and against any and all claims, damages, losses, costs or other expenses that arise directly or indirectly out of or from (i) your breach of these terms; and/or (ii) your activities and/or conduct in connection with this App.


7. Termination

7.1. We reserve the right to cease operating the App at any time, in our sole discretion, without notice to you, and to terminate this agreement by notifying you of same within a reasonable period of time.

7.2. In the event that your medical practice does not pay the agreed license fee, we reserve the right to cease operation of the App or to remove your user account.

7.3. In the event you breach any of these terms, we may cancel or suspend your use of the App at any time, without notice to you, and terminate this agreement by notifying you of same within a reasonable period of time.

7.4. On termination for any reason, you must immediately delete or remove the App from any and all mobile devices, and immediately destroy all copies of the App in your possession or control.

7.5. At any time, you may terminate this agreement by contacting mederequest@gmail.com. In such event, you undertake to immediately stop using the App, and to delete the App.


8. General

8.1. med-E-request may revise these Terms at any time without notice. Although we will endeavor to highlight any changes to these Terms, you should revisit the App periodically to make sure you are aware of the most recent Terms, because they will be binding on you.

8.2. In respect of any proceedings arising out of or in connection with this Agreement, the parties agree that this agreement will, for purposes of jurisdiction, have been concluded at our head office at Cluster Box 5120, Augusta Country Estate, Gillitts.

8.3. If you have any questions or complaints regarding these Terms or have any queries or comments in relation to the App, please contact us on mederequest@gmail.com and we will endeavor to respond to you promptly.

8.4. Each provision of these Terms will be severable from the other provisions. Should any provision be found by a court of competent jurisdiction to be invalid or unenforceable for any reason, the remaining provisions of these Terms will nevertheless remain binding and continue with full force and effect.
